Former Insurance Defense Lawyers Now Working for Injury Victims

Most injury firms learn how insurance companies operate by fighting them from the outside. Our attorneys learned it from the inside. Founding partner Troy Hunter spent 16 years in insurance defense litigation, mostly as a partner at Floyd, Pflueger & Ringer, defending insurers and their corporate clients against personal injury, wrongful death, fire loss, and construction defect claims. Attorney David D. Mordekhov spent two decades at the Seattle defense firm Gardner Trabolsi & Mordekhov, trying high-stakes wrongful death, catastrophic injury, and product liability cases before judges and juries across Washington.

That background changes how we build your case. We know which records adjusters look for, how claims get valued internally, when an insurer is likely to settle, and when it is preparing to fight. We prepare every claim as though it will go to trial, because insurance companies pay more fairly when they know the lawyer across the table is ready to try the case.

Our attorneys have argued at every level of the Washington court system, from district court to the Washington Supreme Court, and Troy also serves as a dispute mediator. Both Troy and David are rated AV Preeminent by Martindale-Hubbell, David has been selected to the Super Lawyers list and teaches trial and deposition skills as faculty at the National Institute for Trial Advocacy, and the firm is a member of the Washington State Association for Justice. Associate attorneys Warren Barreiro and Hannah Shergold round out a team that you can learn more about on the page for our attorneys.

Washington Personal Injury Cases We Handle

We take on injury cases of every size. Our practice focuses on the following areas.

Car, Truck, and Motorcycle Accidents

Whether you were a driver, passenger, cyclist, or pedestrian, a car accident can leave you with medical bills, missed work, and an insurance company looking for reasons to pay less. We handle crashes on I-90, I-405, I-5, and local roads throughout King County, including semi-truck crashes that involve commercial carriers and federal safety rules, collisions that injure motorcycle riders, and bus accidents. We hold the at-fault driver and any responsible company accountable while making sure you get the medical care you need.

Construction Accidents

Property owners, general contractors, and developers have a duty to keep job sites safe, from fall protection to properly erected scaffolds and cranes. When they cut corners, workers and members of the public get hurt. We pursue third-party claims for construction site injuries, including falls from ladders and scaffolds, trench collapses, electrocution, and forklift and crane accidents. These claims can provide compensation beyond what workers’ compensation covers.

Medical Malpractice

Doctors and hospitals cannot guarantee a good outcome, but they must meet the accepted standard of care. When they fall short, the results can be devastating. We investigate surgical errors, misdiagnosis and delayed diagnosis, prescription errors, birth injuries, and treatment performed without informed consent. If you believe medical negligence harmed you or someone you love, we will work with qualified medical experts to find out what happened and who is responsible.

Traumatic Brain Injuries

A brain injury can follow a car crash, a fall from a ladder, or a slip on an icy entryway, and the symptoms are not always obvious at first. Insurers often dispute these injuries because they do not always show up on a scan. We push for a prompt diagnosis and appropriate treatment, and we build the medical and vocational evidence needed to value a brain injury that may affect you for the rest of your life.

Slip and Fall and Premises Injuries

Stores, apartment complexes, and other businesses must keep their property reasonably safe for visitors. Wet floors, poor lighting, broken stairs, and falling merchandise cause serious injuries every year. If you were hurt in a slip and fall at a store or on someone else’s property, we can determine whether the owner or manager failed to fix or warn about the hazard.

Wrongful Death

When negligence takes a life, Washington law allows the spouse, children, other qualifying family members, or the estate to seek compensation for medical and funeral expenses, lost financial support, and the loss of love and companionship. We handle each wrongful death claim with care and patience, so families can focus on one another while we pursue accountability.

Results for Injured Clients and Families

Our attorneys have recovered significant compensation for people across the Puget Sound region. Recent outcomes include a mid-six-figure settlement for a family of five whose minivan was forced into the I-5 center barrier by a semi-truck, a mid-six-figure settlement for an elderly woman struck by a transit bus in a downtown Seattle crosswalk, and more than $1 million for parents whose newborn died after a hospital failed to adequately test for Group B Strep. That case also led the hospital to change its procedures. You can review more of our case results. Every case is different, and past results do not guarantee a future outcome.

Frequently Asked Questions About Washington Personal Injury Claims

How long do I have to file a personal injury lawsuit in Washington?

In most cases, Washington gives you three years from the date of the injury to file a lawsuit under RCW 4.16.080. Wrongful death claims also generally have a three-year deadline. Medical malpractice claims must usually be filed within three years of the negligent act or one year from when you discovered or reasonably should have discovered the injury, whichever is later. Claims against cities, counties, school districts, and other government agencies require a formal tort claim to be filed first, followed by a 60-day waiting period before a lawsuit can be filed. Because these deadlines can be complicated, it is best to speak with a lawyer as early as possible.

Can I still recover compensation if I was partly at fault?

Yes. Washington follows a pure comparative fault rule. Your compensation is reduced by your percentage of fault, but you are not barred from recovery. If you were found 30 percent responsible for a crash, for example, you could still recover 70 percent of your damages. Insurance adjusters often overstate an injured person’s share of the blame, which is one reason it helps to have a lawyer review the facts.

How much does it cost to hire Injury Law Group NW?

Your first consultation is free and confidential. We handle personal injury cases on a contingency fee basis, which means we are paid only if we recover compensation for you. If there is no recovery, you owe us no attorney fee.

Who pays my medical bills after a car accident in Washington?

Washington auto insurers must offer personal injury protection (PIP) coverage, and it is included in your policy unless you rejected it in writing. PIP can pay medical expenses and some lost wages regardless of who caused the crash. Health insurance may also cover treatment. Ultimately, the at-fault driver’s insurance should be responsible for your losses, and we work to coordinate these sources so your bills are handled while your claim moves forward.

Should I give a recorded statement to the other driver’s insurance company?

You are generally not required to give a recorded statement to the at-fault driver’s insurer, and it is wise to speak with a lawyer first. Adjusters are trained to ask questions that can be used to minimize your injuries or shift blame to you. Having spent years on the defense side, our attorneys know exactly how those statements get used.

What is my personal injury case worth?

The value of a claim depends on the severity of your injuries, your medical expenses, lost income, how the injury affects your daily life, and the available insurance coverage. Compensation in Washington can include past and future medical care, lost wages and earning capacity, and pain and suffering. We evaluate cases the same way insurance companies do, so we can tell you what a fair recovery looks like and push for it.

Do your lawyers speak languages other than English?

Yes. Attorney David Mordekhov is fluent in Russian, and attorney Warren Barreiro speaks Spanish. We regularly help Russian, Ukrainian, and Spanish speaking clients throughout the Seattle area.
